1. Acceptance of Terms
By accessing aulonainsurancegroup.com (the “Website”) or utilizing the services of Aulona Insurance Group LLC (“Agency,” “we,” “us”), including our SMS text messaging services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must immediately cease use of the Website and our services.
2. Insurance Services & TDI Disclaimer
Aulona Insurance Group LLC is a licensed Property & Casualty insurance agency operating under the regulations of the Texas Department of Insurance (TDI).
- No Binding Authority via Website or SMS: Insurance coverage cannot be bound, altered, canceled, or modified by leaving a voicemail, sending an email, or sending an SMS text message. Coverage is only bound when explicitly confirmed in writing by a licensed agent or the carrier.
- No Quote or Premium via the Website, SMS, or Email: No quote and no premium figure is provided through the Website, SMS, or email. Coverage is quoted only on a recorded call with a licensed agent of the Agency, and bound only on that written confirmation.
- Informational Content Only: The articles and pages on the Website are general information about insurance in Texas. They are not a quote, an offer, a policy, or advice about your situation. Confirm your own circumstances with a licensed agent of the Agency before relying on anything published on the Website.
3. SMS Text Messaging Program (A2P 10DLC Compliance)
The Agency utilizes an Application-to-Person (A2P) SMS messaging program to communicate with clients and prospects. By participating, you agree to the following strict parameters:
- Program Description: Aulona Insurance Group LLC sends SMS messages in three categories: insurance quotes, policy updates including renewals and billing notices, and account services including document requests and appointment reminders.
- Explicit Consent: Users opt in to receive SMS messages by checking the consent box on a Website form, or by giving express consent on a call with the Agency, which the Agency records. Consent to receive text messages is not a condition of purchasing any insurance policy, goods, or services from the Agency.
- Message Details: Message and data rates may apply. Message frequency varies based on your account activity and inquiries.
Opting Out, Rejoining, and Getting Help
- Opt-Out Instructions: You may cancel the SMS service at any time. Simply reply STOP, CANCEL, UNSUBSCRIBE, QUIT, or END to any text message you receive from us. Upon receiving your opt-out request, we will send one final confirmation message acknowledging your request. After this, you will no longer receive SMS messages from the Agency. Rejoining (Opt-Back In): If you wish to resume receiving SMS messages after opting out, you must reply UNSTOP to the thread.
- Help Instructions: If you experience issues with the messaging program, reply HELP to any message from the Agency for more assistance, or call the Agency on (945) 600-6008.
- Carrier Liability Disclaimer: Mobile network carriers (including but not limited to AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.
4. Prohibited Conduct & Legal Compliance
You agree to use the Website and messaging services only for lawful purposes. You are strictly prohibited from utilizing our platforms to transmit any material that is illegal, misleading, defamatory, or violates federal/state regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. The Agency strictly prohibits the transmission of content related to Sex, Hate, Alcohol, Firearms, or Tobacco (SHAFT), fraud, or deceptive marketing.
5. Intellectual Property
All content, branding, architecture, and intellectual property on the Website are the exclusive property of Aulona Insurance Group LLC. Unauthorized reproduction, scraping, or distribution is strictly prohibited.
6. Limitation of Liability
To the maximum extent permitted by Texas law, Aulona Insurance Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to, use of, or inability to use the Website, the SMS messaging services, or any third-party links provided. All services are provided on an “AS-IS” and “AS-AVAILABLE” basis without warranties of any kind.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be instituted exclusively in the state or federal courts located in Collin County, Texas.
Prior to initiating any legal action, the aggrieved party must provide thirty (30) days written notice to the other party identifying the alleged breach and an opportunity to cure.
